  - question: "Is product recall coverage included in product liability?"
answer: "Do not assume so. General or products liability may address certain third-party injury or property-damage allegations, while recall coverage can address distinct first-party recall costs and third-party recall liability. The actual policy controls."
  - question: "What should a product recall submission include?"
answer: "Use the recall application and send five years of recall and general-liability losses, quality-control and recall plans, current declarations, product catalog and relevant FDA, CPSC or other regulatory notices."
  - question: "Which businesses should discuss recall coverage?"
answer: "Raise it for food, beverages, consumer goods, electronics, components, medical products, cannabis products, pharmaceuticals, supplements, cosmetics and any product where a defect could reach many customers. Eligibility and terms are determined case by case."

Product recall is its own coverage question. A products or general-liability policy may respond to certain third-party bodily-injury or property-damage allegations. That does not answer whether the insured has coverage for removing products from the market, notifying customers, replacing stock, protecting a brand or managing a regulatory withdrawal.

## Does product liability cover recall costs?

Recall comes up most often when a manufacturer, importer, distributor or retailer can identify affected products and move them through a supply chain. Food, consumer products, electronics, components, medical products, cosmetics, supplements, cannabis products and children's goods may all need a recall discussion, but the product, distribution chain and coverage request matter more than the industry label.

## What recall coverage needs to address

| Question | What to identify |
| --- | --- |
| Product and defect | Product description, batch or date codes, defect or contamination scenario and units affected |
| Distribution chain | Manufacturer, importer, private labeler, distributor, retailer, sales territory and inventory location |
| Recall response | Stop-sale process, customer notice, remedy, reverse logistics, testing and redesigned production where applicable |
| Loss history | Recall events, product and GL losses, complaints, warranty claims, injuries, open claims and notices |
| Coverage structure | Requested recall limit, deductible or participation, first- and third-party concerns, underlying products coverage and excess |

For consumer products, the CPSC's [required report information](https://www.cpsc.gov/Business--Manufacturing/Recall-Guidance/Required-Report-Information) shows the kinds of records a company may need to assemble: product identification, country of origin, complaints, injuries, testing, distribution and corrective-action information. Its [recall checklist](https://www.cpsc.gov/Business--Manufacturing/Recall-Guidance/Recall-Checklist) also illustrates why traceability and a written response plan matter before a loss.

## Product recall submission checklist

To get the fastest recall review, include recall and general-liability loss history, regulatory notices, quality-control and recall plans, declarations and a product catalog. The product, loss history and requested coverage determine any additional forms.

- [ ] Completed recall application and standard application(s), with the requested recall limit, deductible or participation and effective date.
- [ ] Product catalog, labels, product pages, brand names, model, lot, batch, UPC or date-code information, and country of origin where applicable.
- [ ] Exact role in the distribution chain: manufacturer, importer, private labeler, distributor, retailer or online seller.
- [ ] Annual revenue, unit volume, sales territory, customers, distribution channels and inventory locations.
- [ ] Written recall plan, quality-control procedures, supplier controls, testing protocols, complaint handling and traceability process.
- [ ] Five years of currently valued recall and general-liability loss runs, with narratives for claims, complaints, warranty matters, injuries, recalls and open events.
- [ ] Current and expiring declarations, prior loss information and the underlying products or general-liability structure.
- [ ] FDA, CPSC or other regulatory notices, consumer complaints, test reports or corrective-action records when they exist.
- [ ] Property, stock, cargo, warehouse and reverse-logistics details when the coverage discussion includes those exposures.

## A recall plan is not an insurance policy

A documented recall plan helps explain whether the insured can identify affected units, stop sale, notify the supply chain and carry out a remedy. It does not establish that a policy covers every cost of a recall. Keep the operational plan, the requested insurance coverage and the terms of an eventual policy separate.

Submit the recall material you have. We review the product, distribution path and requested coverage to separate the recall question from the products or general-liability question, then identify what else is needed before approaching the market.
