A loss changed the renewal conversation

A retail agent brought Nomos a bar account after its insurer advised that it would not offer renewal. The bar had a substantial bodily-injury claim involving allegations of negligent alcohol service. The claim remained unresolved, and the renewal deadline was approaching.

The agent had approached its usual admitted options. Those insurers declined because of the loss history and the bar’s operating profile. The business was still trading, but the agent had no replacement option to present to the owner.

The immediate challenge was not finding a lower premium. It was obtaining a viable general liability and liquor liability placement for an operation carrying a serious unresolved claim.

Start with the reason insurers were declining

Nomos began with the loss. Working through the agent, we obtained an account of the incident, the available claim information and an explanation of what the owner had changed afterward. We kept the allegations separate from established facts and did not describe the claim as resolved.

The owner had introduced documented alcohol-service training, revised escalation procedures and closer management oversight during late operating hours. We requested supporting information about those measures alongside the bar’s current hours, sales mix and entertainment.

Those changes did not remove the loss from the record. They gave underwriters a fuller account of the circumstances, the claim’s current status and how the business was being managed following the incident.

Develop an E&S option around the disclosed risk

Nomos approached E&S insurers willing to evaluate the loss circumstances. The underwriting discussion addressed the incident, the changes made afterward and the exposures that remained part of the operation.

When terms became available, the focus shifted to what the proposed policies offered. We walked the agent through the GL and liquor liability arrangements, including the quoted exclusions, retentions and remaining requirements. The agent could then explain both the available option and its limitations to the owner.

The client accepted a replacement E&S placement, and the required steps were completed before the expiring policies ended. The replacement was prospective insurance; it was not a solution to the existing claim. The placement did not depend on presenting the loss as resolved or promising identical terms to the expiring policies.
